Ohio Family Sues Cincinnati Nursing Home Over Alleged Negligence Resulting in Wrongful Death

CINCINNATI, Ohio – A Cincinnati nursing home is facing a lawsuit from an Ohio family, alleging negligence and wrongful death after the passing of their relative, Dolores Niederhelman, who reportedly died following an attack by another resident. The family claims that the nursing home failed to provide proper care and notify them of the incident.

Niederhelman’s family, represented by a law firm, asserts that she sustained severe injuries, including two broken shoulders, due to the attack by another resident at the facility. Despite the attack being caught on surveillance camera, the nursing home allegedly did not adequately examine Niederhelman post-assault or inform her family about the incident.

Three Rivers Healthcare Center, part of a large nursing home chain, is the target of the lawsuit. Niederhelman, who had a history of health issues, was under the care of the center and was placed in a secured unit due to her cognitive impairment. The incident occurred on January 26, 2023, when a female resident attacked Niederhelman in her room, leading to her distress.

Following the assault, Niederhelman was eventually sent to the hospital, where it was discovered that she had sustained fractures on both shoulders. However, she continued to deteriorate due to complications from the injuries and developed infections, ultimately passing away on January 30, 2023. The lawsuit alleges negligence, wrongful death, and violations of nursing home resident rights laws against the facility, citing insufficient staffing and systemic failures in care provision.

In response, the law firm representing Niederhelman’s family expressed their commitment to pursuing justice and accountability for the incident.
