Police said the victim woke up to an intruder inside his bedroom early Sunday.
MIAMI, Fla. — A 34-year-old Miami man was arrested after police said he entered an occupied apartment early Sunday and sexually touched a sleeping resident before urinating on him and leaving the room.
Maykel Rodriguez Jr. faces charges including burglary of an occupied dwelling, battery and indecent exposure after the incident at an apartment on Northwest 11th Street. The arrest drew attention because of the claims in the police report and a judge’s decision to keep Rodriguez in custody pending his next court appearance.
The incident happened shortly before 4 a.m. Sunday at an apartment in the 4200 block of Northwest 11th Street in Miami’s Flagami area, according to police. The victim told officers he had walked friends to the parking lot, returned to his room and went to sleep. He later told police he could not remember whether he locked the door. Investigators said the victim woke up with a man on top of him and touching him over his clothing. The victim said the man then exposed himself and urinated on him before leaving. As the man grabbed his clothes, he told the victim, “I know you,” according to the arrest report.
The victim gave officers a description of the suspect, and police found Rodriguez nearby at Northwest 43rd Avenue and 11th Street. Investigators said the victim later positively identified Rodriguez. Police said Rodriguez refused to answer questions before he was arrested. Officer Kiara Delva, a Miami police spokesperson, called the case “extremely concerning and disturbing” and said investigators had not confirmed Rodriguez’s claim that he knew the victim. The victim’s name was not released. Police have not said whether there was any sign of forced entry, and the report left that point unclear.
Rodriguez lives a few blocks from the apartment, according to reports citing police records. Jail records listed him as 34 years old. During his first court appearance, his defense attorney asked for bond and noted that Rodriguez had served in the U.S. Air Force. The court also heard that he worked as a loan officer. Prosecutors argued against his release, saying the allegations involved an occupied home and physical contact with the victim while the victim was asleep.
Miami-Dade Circuit Judge Mindy Glazer ordered Rodriguez held without bond until his next court appearance. The judge also ordered him to stay away from the victim. The case remained in an early stage, and Rodriguez had not been convicted. Prosecutors may review the arrest report, witness statements and any available building records or video before deciding how to proceed. Court records will determine whether the filed charges change as the case moves forward.
The case began with a call from the victim soon after the alleged break-in. Officers canvassed the area and located Rodriguez after receiving the suspect description, police said. The apartment building sits in a residential stretch west of central Miami, near other homes and small businesses. Police said the victim’s account, the location of the suspect and the identification by the victim formed the basis for the arrest.
Rodriguez remained in Miami-Dade custody after the bond hearing. His next court date will set the next step in the case, including whether prosecutors file formal charges or seek any changes to the counts already listed.
