Melbourne, Australia – The Director of Public Prosecutions in Victoria is seeking a tougher penalty for two prominent neo-Nazis accused of a “terrifying” group assault. Thomas Sewell, 31, and Jacob Hersant, 25, were acquitted last year following charges of violent conduct towards hikers at Cathedral Ranges State Park in May 2021. They admitted to a charge of violent disorder and were given lenient sentences by Judge Kellie Blair.
The prosecution has now appealed the sentence, arguing that it was grossly inadequate considering the gravity of their actions. According to chief crown prosecutor Brendan Kissane KC, the offense carried a maximum penalty of 10 years, and the men deserved a lengthier prison term. They were accused of leading a violent attack on a group of innocent hikers, an act that left the victims traumatized. Sewell was associated with the European Australian Movement while Hersant led the National Socialist Network.
The incident occurred when a hiker noticed several men wearing Celtic cross T-shirts, a symbol linked to neo-Nazi groups, and began filming. This led to a confrontation where the group, including Sewell and Hersant, vandalized the hikers’ vehicle and stole their phones. Despite claims of honorable behavior and self-defense against anti-fascists, the prosecution argued that the judge erred in downplaying the seriousness of the offense.
After spending over six months in custody, Sewell insisted that the appeal was politically motivated, emphasizing his peaceful demeanor during his time incarcerated. The sentencing of Hersant, who was only 22 at the time of the incident and had no previous violent convictions, was considered appropriate by his defense due to his commitment to community service. The appeal is under review by a panel of judges, who will deliver a verdict at a later date.
