Daylesford, Australia – A catastrophic event on November 5, 2023, involving a vehicle collision at the Royal Daylesford Hotel’s outdoor beer garden shocked the community, claiming five lives and leaving others injured. The driver, described as a retired New Zealand-born man named Swale, is now facing significant charges, including five counts of culpable driving causing death.
The crash had devastating consequences for two families in particular. Among the victims were Pratibha Sharma, a 44-year-old woman from Point Cook, her nine-year-old daughter Anvi, and her husband Jatin Kumar, aged 30. Their friends from Tarneit, Vevek Bhati and his son Vihann, only 11 years old, were also killed in the incident. Bhati’s partner and their young six-year-old son sustained injuries.
Prosecution asserts that Swale, who suffers from diabetes, had ignored multiple warnings from his continuous blood glucose monitor before the accident occurred. Despite these alerts, it is alleged that he failed to manage his condition adequately on the day of the crash. Swale’s defense attorney, Dermot Dann KC, claims that his client was undergoing a severe hypoglycaemic attack during the crash, which he described as a “tragic accident.”
Eyewitness accounts add more layers to the tragic event. Martin Hinck, an employee at a nearby wine bar, witnessed the aftermath and described Swale appearing severely disoriented and in poor condition immediately following the incident. Further supporting this, Paramedic Michael Barker noted that when medical help arrived, Swale was barely conscious with dangerously low blood glucose levels, putting him at imminent risk of coma or even death.
Adding to the complexities of the case, it emerged during the hearing that there was no evidence of alcohol consumption by Swale on the day of the incident, corroborated by three individuals who had attended the same national clay target shooting championship as Swale.
Throughout his life, Swale had been treating his insulin-dependent diabetes since 1994 and, according to his general practitioner who testified in court, had generally managed his condition effectively. This long history of medical management is part of the defense’s argument highlighting the unexpected nature of the hypoglycaemic attack.
The ongoing legal proceedings are overseen by Magistrate Guillaume Bailin, drawing significant attention due to the tragic outcomes and the circumstances surrounding the crash. As the community mourns the irreplaceable loss of life, there is mounting scrutiny on the balance between personal health management and public safety.
