Ocala, Florida – Prosecutors in Florida have announced their intention to seek the death penalty for a 39-year-old man accused of opening fire in a busy mall days before Christmas Eve, resulting in the death of one man and the serious injury of a woman.
Albert J. Shell Jr. was indicted by a grand jury on one count of first-degree murder with a firearm in the December 2023 killing of David Nathaniel Brown. The Office of the State Attorney for the Fifth Judicial Circuit officially filed a notice of intent to pursue the death penalty against Shell, who also faces two counts of attempted second-degree murder with a firearm and one count of being a felon in possession of a firearm.
According to a news release from the state attorney’s office, the decision to seek capital punishment for Shell was made due to “the severity of the crime and its impact on the community.” State Attorney Bill Gladson stated, “The State Attorney’s Office acknowledges the sensitivity of this matter and the impact it has on the community. Our commitment to ensuring justice and holding criminals accountable for their actions remains unwavering.”
The targeted attack occurred at the Paddock Mall in Ocala, Florida around 3:40 p.m. on Dec. 23, 2023. While initially reported as an active shooter situation, it was later determined that a shooting had taken place resulting in the death of one man and the injury of a woman.
Witness accounts and surveillance footage depicted a sequence of events where Shell allegedly confronted the victim outside a restaurant within the mall, leading to a physical altercation and the fatal shooting. Shell was arrested on January 8, 2024, by law enforcement officials.
Records show that Shell has a history of arrests, including an incident in July where he was accused of assaulting his girlfriend in front of her young son. He has also been charged with witness intimidation for allegedly calling the victim a “snake” for cooperating with the police.
