Fontana Man Faces Murder Charges After DUI Incident Claims Life of Teen Girl in Newport Beach

Newport Beach, Calif. – A tragic incident unfolded in Newport Beach, California, as a Fontana man with a history of DUI convictions, Joseph Alcazar, was accused of driving under the influence with his 8-year-old daughter in the car when he struck and killed a 14-year-old girl crossing the street. This devastating event has led prosecutors to charge Alcazar with murder and DUI-related offenses, potentially facing a sentence of 15 years to life in prison plus six years. Orange County District Attorney Todd Spitzer’s office is handling the case, with Alcazar’s arraignment being postponed to June 14 while he remains in custody without bail.

According to investigators, the fatal incident occurred when Alcazar hit and fatally injured Rosenda Elizabeth Smiley, a 14-year-old from Rialto, on Saturday. Tragically, another young girl, a 13-year-old, was also injured when Alcazar allegedly ran over her foot. The series of events that led to this tragedy were described in a statement from the DA’s office, shedding light on the reckless actions that resulted in loss of life and injuries.

Alcazar’s blood alcohol level was reported to be “twice the legal limit” at the time of the incident, highlighting the dangerous consequences of driving under the influence. Not only was Alcazar’s daughter in the vehicle during the collision, but another man was also present. The DA’s office further revealed that Alcazar had prior convictions for DUI, one of which involved a serious single-vehicle crash that left him injured.

In response to this senseless tragedy, District Attorney Todd Spitzer emphasized the heartbreaking impact of Alcazar’s actions, stating, “A 14-year-old girl living the California dream enjoying a day of sun and sand at the beach with friends to kick off the beginning of summer is dead because of the selfish decision of a stranger.” Spitzer condemned Alcazar’s behavior as a repeat drunk driver, highlighting the risks he posed not only to the young victims but also to his own daughter and others who witnessed the fatal collision.

The devastating consequences of drunk driving have once again been brought to the forefront with this tragic incident in Newport Beach. As the legal proceedings continue and the community mourns the loss of a young life, the importance of preventing such incidents through education, awareness, and accountability remains crucial in ensuring public safety on the roads.
