Flagler County Man Sues Dunkin’ Donuts After Toilet “Explosion” Incident In Winter Park

WINTER PARK, Fla. – A man from Flagler County has filed a lawsuit against a local Dunkin’ Donuts after experiencing a traumatic incident nearly two years ago. According to court documents filed on Wednesday, the man, identified as Paul Kerouac, visited a Dunkin’ Donuts location along Aloma Avenue in Winter Park on January 6, 2022.

The lawsuit alleges that while at the store, the toilet in the men’s bathroom exploded, causing human feces and urine to cover the bathroom and Kerouac. Court records indicate that upon exiting the bathroom, Kerouac sought assistance from store employees for cleaning himself.

The lawsuit further claims that employees were aware of previous issues with the toilet, which had been problematic in the past. As a result of the traumatic restroom experience, Kerouac reportedly requires mental health care and counseling, and has suffered severe and long-term injuries.

Alleging negligence on the part of Dunkin’ Donuts for failure to properly maintain the toilet or provide a warning to Kerouac, the lawsuit seeks damages in excess of $50,000.
