Three other teenagers have been arrested as prosecutors pursue murder, assault and robbery charges connected to Joshua Fuller’s death.
DAYTON, Ohio — Authorities are continuing to search for a 16-year-old boy accused in the shooting death and robbery of a Dayton father as three other teenagers move through proceedings that could place their cases in adult court.
A nationwide warrant has been issued for Lamar Smith in connection with the June 14 killing of Joshua Fuller, 37, outside the Main Mart in the 2400 block of North Main Street, the Montgomery County Prosecutor’s Office said.
Fuller had gone into the store with his 15-year-old son before the shooting, investigators said. Prosecutors allege four teenagers positioned themselves around Fuller’s vehicle while the father and son were inside.
When Fuller and his son returned, authorities allege one of the teenagers drew a gun and shot Fuller. Prosecutors identified the alleged shooter as Jamere Brown, 17. Brown and two others then ran from the scene, investigators said.
Prosecutors allege the fourth teenager remained behind, pointed a gun at Fuller’s son and searched Fuller’s pockets before fleeing. Officials have not released additional details about what, if anything, was taken.
Fuller’s son was not physically injured in the account released by prosecutors. His identity has not been made public because he is a minor. Authorities have not disclosed further information about the family.
Brown, Jamaal Burrow, 16, and Charles Smith were arrested after the killing. Police found two suspects in the 1600 block of Russet Avenue the day after the shooting, and a third teenager was taken into custody two days later, according to investigators.
All four teenagers face four counts of murder, two counts of felonious assault and two counts of aggravated robbery, prosecutors said. The counts carry three-year firearm specifications. The allegations have not been proven in court.
Prosecutors have sought to move the cases involving the three arrested teenagers out of juvenile court. Officials said the transfers are mandatory after a probable-cause finding because of the defendants’ ages and the seriousness of the charges.
Assistant Prosecuting Attorney Kelly Madzey said the alleged attack represented an extreme level of violence and argued that the juvenile system could not adequately account for the conduct described by investigators. She also said the system would not provide enough time to rehabilitate the defendants safely.
The prosecutor’s office alleges Lamar Smith and Charles Smith were connected to a series of other carjackings and aggravated robberies before Fuller was killed. Those accusations are part of separate pending charges and do not constitute findings of guilt.
Law enforcement officers are still working to locate Lamar Smith. Prosecutors have not announced additional arrests, and the adult-court cases involving the other defendants remain pending.
