Troy, Michigan — A tragic incident at a Michigan recovery center that resulted in the death of a 5-year-old boy is culminating in legal action, according to the boy’s family attorney. The young victim, Thomas Cooper, was undergoing treatment for sleep apnea and ADHD at the Oxford Recovery Center on January 31 when the hyperbaric chamber he was in exploded, leading to his death and injuring his mother, who was present in the room at the time.
In the wake of the catastrophe, the family retained legal representation from Fieger Law Firm. Attorney James Harrington, representing the family, voiced strong concerns about the center’s operational practices and flagged the industry’s lack of regulation in Michigan. Harrington highlighted the absence of scientific backing for the efficacy of hyperbaric treatments for certain medical conditions as advertised by the facility.
“This is an event that should never occur. Such incidents only arise from negligence,” Harrington stated. He criticized the state’s regulatory framework for the hyperbaric treatment industry, emphasizing that more stringent oversight is necessary to prevent such incidents.
The attorney remarked on the profound impact of the event on the family, describing it as an unimaginably painful experience for any parent. He underscored the need for accountability and answers about the factors that led to the explosion.
Initial investigations into the Oxford Recovery Center have brought to light several legal and ethical issues concerning the center’s business practices. Allegations have emerged about the center possibly misleading clients regarding what its treatments can effectively address.
“The legal violations and dubious business practices that were previously flagged about the employees are elements of the broader investigation we are conducting,” Harrington explained, signifying that these issues are integral to understanding the full scope of the incident.
The attorney has asserted that the lawsuit will be officially filed once their investigation reaches sufficient depth to support their claims. He called for community support for the grieving family while the legal processes unfold.
“This is extremely hard for them. They are a family from Metro Detroit, devastated by their loss,” Harrington said. He requested the public’s empathy and prayers for the family during this challenging time.
This case has prompted discussions around the safety protocols and regulatory measures necessary in medical facilities offering novel treatments. It also raises questions about the responsibility such facilities bear in ensuring the well-being of their clients, especially when vulnerable populations are involved. Further developments in the investigation and subsequent legal actions are awaited as the community and legal observers watch closely.
