Family: Man fatally shot shielding elderly woman in Third Ward home

Relatives identified the man killed as Spencer Germany, 45; police say the suspect is 28-year-old Rogers McFarland Jr.

HOUSTON — A Houston man is jailed on a murder charge after a deadly shooting inside a home on the 3300 block of Anita Street just after midnight Jan. 29. Officers found the victim wounded in the front room; he later died at a hospital, police said.

Authorities said the suspect, identified as Rogers McFarland Jr., 28, was detained nearby and booked into the Harris County Jail. Relatives identified the man who was killed as Spencer Germany, 45, describing him as protective of family. A magistrate judge set bond at $750,000. The case is at the charging stage, and investigators are still gathering statements and evidence while prosecutors review potential enhancements. Officials have not announced a motive.

Police said the gunfire began around 12:10 a.m. inside the residence. Witnesses told detectives McFarland walked in, pointed a pistol and fired multiple times. Officers and firefighters arrived within minutes and began clearing the house and aiding the wounded man. Paramedics took Germany to a nearby hospital, where he was pronounced dead. Patrol units searched several blocks and located McFarland, who, according to the department, was “detained without incident.” Detectives later met with the district attorney’s office, which accepted the murder charge in the 176th Criminal District Court.

In early interviews, family members told police Germany had stepped in to protect an elderly woman shortly before shots were fired. Investigators collected shell casings and photographed the living room and entryway. Police did not immediately release the number of rounds recovered, but neighbors reported hearing a quick burst of gunfire. The Harris County Institute of Forensic Sciences confirmed the victim’s identity and notified next of kin. Officials emphasized that the shooting occurred inside the home and said there was no ongoing threat to the wider community.

The Third Ward block where the shooting occurred sits near Tierwester Street, a corridor that mixes historic homes with newer construction. While most calls in the area involve noise complaints and domestic disputes, occasional gunfire has drawn police in prior months, according to dispatch logs. Residents said overnight activity is common on weekends, which can complicate witness accounts. In this case, investigators are focusing on interactions among people who knew each other and whether prior arguments in the household preceded the shooting.

After the booking, prosecutors filed the murder count and set the initial appearance on the trial court’s docket. Jail records showed McFarland remained in custody Wednesday. The court will address counsel, discovery and any future bond conditions at upcoming settings. Detectives said they expect ballistic testing results and additional interviews to be added to the file this week. If further facts emerge, prosecutors could amend or supplement the charge. Officials did not indicate whether any other arrests are expected.

On Anita Street, a handful of candles and flowers appeared on the porch by afternoon. “He always tried to keep the peace,” said a relative, who asked not to be named. A neighbor described waking to sirens and seeing cruisers lining the block. “It was quiet, then the lights lit up the whole street,” said Marcus King, who lives two doors down. By sunrise, crime scene tape had come down, but officers returned through the day to check on residents and follow up with witnesses.

As of Wednesday, the homicide investigation remains active, with the next update expected after lab work and additional statements are submitted to prosecutors. The court calendar is expected to list an initial hearing once paperwork is finalized.
