Decatur, Ill. — A man injured in a 2023 explosion at the ADM east plant has initiated legal action against the company, alleging negligence and violations related to hazardous materials. The lawsuit, filed by Kaleb Ogilvie in late August, asserts that ADM failed to adhere to federal safety standards for the handling of hexane gas.
According to court records from the Circuit Court of the Sixth Judicial Court in Macon County, the lawsuit contends that Ogilvie was not adequately informed of existing safety hazards within the facility. It claims that ADM was aware of the potential for an explosion stemming from these issues but neglected to take action.
Ogilvie’s lawsuit highlights that the company made a “deliberate decision” not to install a critical Lower Explosive Limit hexane sensor. As a result of the incident, Ogilvie sustained severe injuries, including extensive burns and multiple skull fractures. His condition was life-threatening, necessitating a medically induced coma for several weeks to facilitate recovery. Documentation from medical professionals details advanced burns to his face, torso, and arms, along with significant lung damage due to inhalation injuries.
