ALBANY, N.Y. — A significant settlement has been reached concerning Central Hudson Gas & Electric Corporation following a devastating explosion in Wappingers Falls in November 2023. The incident, which injured 15 people and leveled several homes, has led the State Public Service Commission to impose a multi-million dollar penalty on the utility company.
As part of the settlement, Central Hudson acknowledged deficiencies in providing safe and adequate service. The commission mandated a $5 million payment aimed at benefiting ratepayers and initiated a gas safety protocol remediation fund ranging from $2.5 million to $3.5 million. These funds are designated for implementing targeted safety measures to prevent similar disasters in the future. Notably, the financial responsibility for these payments will fall on company shareholders and not on the ratepayers, as confirmed by the commission.
Legal actions concerning civil claims against Central Hudson are still ongoing. Attorney Joseph O’Connor, representing one family affected by the explosion, expressed gratitude for the commission’s efforts, emphasizing the profound impact of the tragedy on the community. “This preventable catastrophe has changed the lives of so many people. The injuries that all of these folks suffered are unimaginable,” O’Connor stated.
An investigation conducted by the Department of Public Service revealed that on November 2, Central Hudson’s contractors inadvertently struck an unmarked natural gas line, resulting in a high-pressure leak. Shortly after, an explosion occurred at 7 Brick Row, igniting a fire that severely injured several individuals, including children, and led to extensive property damage.
Furthermore, the Department of Public Service’s report raised alarming concerns about Central Hudson’s knowledge of the gas service line prior to the incident. Investigators found that the company had failed to include critical information regarding the active line in the project documentation provided to its contractors for the excavation work on Brick Row. This oversight contributed significantly to the dangerous conditions that ultimately resulted in the explosion.
Commission Chairman Rory Christian underscored the importance of public safety in energy distribution. “The commission’s paramount concern is protecting the public and ensuring safety throughout our energy distribution systems,” he stated. He emphasized that enforcement actions are vital in holding utility companies and their shareholders accountable for violations of public safety laws.
As investigations continue and civil cases unfold, the repercussions of this incident highlight the ongoing need for vigilant safety measures within utility operations. The settlement not only serves as a financial penalty but also as a call for accountability and enhanced safety protocols to safeguard communities from similar incidents in the future.
